Idaho Supreme Court

The Supreme Court is Idaho’s court of last resort. It reviews appeals from the Court of Appeals and certain direct appeals from trial courts, particularly those involving constitutional questions or death penalty cases. The Idaho Supreme Court is composed of five justices elected in nonpartisan statewide elections to six-year terms. The justices select one among them to serve as Chief Justice.

Functions:

• Reviews cases on appeal
• Issues written opinions that set precedent for lower courts
• Oversees the administration of Idaho’s entire court system
• Regulates attorney licensing and discipline

Chief Justice G. Richard Bevan is retiring effective October 30, 2026. Justice Robyn Brody, currently Vice Chief Justice, will be elevated to Chief Justice by her fellow justices effective October 1, 2026. Governor Brad Little has selected Fourth Judicial District Judge Jason Scott to succeed Bevan; Scott is scheduled to be sworn in as a justice of the Idaho Supreme Court effective October 30, 2026.
