Revealing the tricky language would greenlight late-term abortions in Idaho

BOISE, Idaho — The pro-abortion activists backing Proposition 1, a wildly liberal abortion measure that will be on Idaho’s November ballot, claim that Prop 1 merely returns abortion policy to what it was under Roe v. Wade. That’s false. The reality is that Prop 1 goes further than Roe v. Wade, allowing abortion on demand, for any reason, up to the 7th or 8th month of pregnancy. To understand how, let’s look at the traditional definition of viability established in Roe v. Wade compared to the re-definition in Prop 1:

Traditional standard (Roe v. Wade) definition of fetal viability: potentially able to live outside the mother’s womb, albeit with artificial aid. (Roe v. Wade, 410 U.S. 113, 1973)

Key here are the words “potentially able to live” and “albeit with artificial aid,” which include things like oxygen, NICU care and ventilators. Compare that with:

From Prop 1’s definition of fetal viability: “has a significant likelihood of sustained survival outside of the uterus without extraordinary medical measures.”

Notice how Prop 1 redefines what makes a baby viable, from “potentially able to live…albeit with artificial aid” to “significant likelihood of sustained survival… without extraordinary medical measures.” Those two inversions of terms move viability from 22–24 weeks into the 7th or 8th month of pregnancy. Under Roe, a premature baby who would survive with NICU support was viable. Under Prop 1, that same baby is not — because its survival depends on “extraordinary medical measures.”

“If they simply wanted to return abortion policy to what existed under Roe v. Wade, they could have used the same definition for viability, but they did not,” said Dr. Megan Linders on behalf of Too Extreme for Idaho. “Words matter, and they used deceptive flips of familiar terms in an effort to trick voters into voting to legalize abortion on demand later than has ever been allowed in Idaho. We will make sure voters know the truth that Prop 1 is too extreme for Idaho.”
