BOISE, Idaho — Idaho Senate Republicans are pushing back against misleading attacks from organizations such as Conservation Voters for Idaho regarding Senate Joint Resolution 103. Claims that this legislation “could transfer and sell off Idaho public lands” are fundamentally false. In reality, SJR 103 is explicitly designed to do the exact opposite. If approved by Idaho voters, it would constitutionally protect any newly acquired public lands from privatization or misuse.

The Truth About SJR 103

SJR 103 proposes a constitutional amendment to establish a framework for the management of any lands granted to or acquired by the state from the federal government in the future. If passed by the legislature and approved by voters in the coming election, this amendment would create a distinct “public lands trust.”

The legislation’s text is unambiguous: “The trust shall remain inviolable and intact for this and future generations. Such lands shall not be sold.” To claim this bill is a vehicle to sell off public lands ignores the plain text of the resolution. While it allows for strategic land exchanges—which are standard practice for consolidating management or improving public access—such exchanges would require a rigorous two-thirds supermajority approval from the Idaho Legislature.

Why Idaho Must Be Prepared Now

There is currently a renewed push from the Trump administration and some members of Congress to transfer federal lands to state or private control. Regardless of whether one supports or opposes the large-scale transfer of federal lands, Idaho cannot afford to be caught without a land management plan.

Without a change of policy, any federal lands transferred to Idaho would be constitutionally required to be managed in such a way as to maximize financial return, creating a pressure to sell or privatize land. This amendment would not only eliminate that pressure but would also both prohibit sale of these lands and provide a legal framework for keeping them public, open, and preserved for recreation and wildlife habitat.

Addressing Federal Mismanagement and Fiscal Realities

For years, Idaho’s rural communities have suffered devastating losses from wildfires exacerbated by federal mismanagement of public lands. Out-of-touch federal regulations have also consistently burdened Idaho’s natural resource industries. State management offers a more localized, responsive, and accountable approach.

Critics argue that Idaho cannot afford the costs of managing these lands, such as wildfire abatement and conservation staffing. While management requires investment, opponents ignore the significant revenue these lands can generate. If voters were to approve SJR 103, revenues derived from responsible, multiple-use management—including timber, grazing, and recreation—would be placed into a dedicated Public Lands Trust Fund strictly prioritized to:

  1. Support and maintain the land operations themselves.
  2. Compensate local counties for public lands within their boundaries.
  3. Improve and increase public access and recreational use.
  4. Support primary and secondary public educational facilities.

SJR 103 is just one proposed measure to defend our state’s sovereignty and cultural heritage. As the legislature considers how best to be proactive in land management policy, Senate Republicans are working to ensure that no matter what happens in Washington D.C., Idaho’s public lands will remain in public hands, managed by Idahoans, for Idahoans.
