RELEASE: Statement on House Bill 822, Protecting Parents’ Rights Regarding Children ‘Transitioning’ Socially or Medically

Boise, ID – Today the Idaho House Democrats attempted to file a Minority Report objecting to House Bill 822 after it passed the House of Representatives on a 59-9 vote.

H822 prohibits schools, healthcare providers and child care providers from facilitating a minor’s medical sex transition or “social transition” without informing, and obtaining the informed consent of, the child’s parent or guardian.

The House voted 55-13 to not accept the Democrat report for inclusion in the House Journal. There are several reasons the report was rejected:

First, committee reports are customarily brief, containing only the most basic facts on what the committee did, while this Minority Report ran to seven pages.

Second, House Rule 27 requires these reports to be respectful, which this Minority Report was not. Rather than simply stating the minority’s objections to the policy enacted by the bill, it devolved into unnecessary personal criticism of the committee chairman. To be clear, the Chairman’s decision to alternate “Pro” and “Con” testifiers for the duration of the time available for public testimony on H822 was perfectly fair, and well within legislative custom.

Third, the Democrat report appeared to be attempting to lay the basis of a lawsuit against the State of Idaho, which is not an appropriate use of a committee report.
