RELEASE: Office of the Attorney General Concludes Investigation into Officer-Involved Shooting in Pocatello

BOISE — Attorney General Raúl Labrador announced that his office has completed its review of the April 5, 2025, officer-involved shooting in Pocatello that resulted in the tragic death of Victor Perez.

Under Idaho law, the Attorney General’s Office does not have independent jurisdiction to review critical incidents. Our office only becomes involved when requested by the county prosecuting attorney. In this case, the Bannock County Prosecutor’s Office asked our office to conduct the review instead of handling it themselves.

Our office did not conduct a separate investigation. The Eastern Idaho Critical Incident Task Force, with the Bannock County Sheriff’s Office as the lead agency, investigated the incident. In May, the task force provided their investigation to our office, and in August the autopsy report was completed and provided. The Attorney General’s Criminal Law Division supplemented the investigation with follow-up interviews as necessary and reviewed the entire case for potential criminal charges.

As the reviewing prosecutor in this matter, our office’s role was limited to determining whether the State could prove beyond a reasonable doubt that the officers involved committed a crime and that their use of force was not justified under Idaho law. The Attorney General’s Office does not make determinations about civil liability, employment discipline, or compliance with department policy.
