NEWS: Mask Mandate Prohibition Passes Senate

Late this morning, House Bill 32, which would prohibit government agencies from imposing mask mandates on Idaho citizens, passed the Senate on a 27-6-2 vote.

Sen. Brian Lenney was the floor sponsor and opened debate, explaining that nobody wants to go through what happened during the Covid lockdowns. He explained that the bill would limit local government agencies to an advisory role, rather than giving them authority to fine or jail citizens who choose not to wear masks. However, he said that it does not stop anyone from choosing to wear a mask. He added that this bill was necessary to restore confidence in government agencies and health districts.

Sen. Jim Guthrie joined Senate Democrats in opposition to the bill, citing local control. Sens. Carl Bjerke, Dan Foreman, Ben Adams, and Tammy Nichols each debated in favor of the bill.

H32 previously passed the House 52-16-2, sponsored by Rep. Rob Beiswenger. It now heads to Gov. Brad Little’s desk to await his signature.

Previous versions of this bill, sponsored by then-Reps. Karey Hanks in 2022 and Jacyn Gallagher in 2024, failed to become law.
